These Terms of Service (“Terms”) govern the downloading, use, and distribution of RAW photos (“Photos”) available through Southend.media.pixieset.com (“Service”) by users (“User”, “You”, or “Your”). By downloading any RAW Photos from Southend.media.pixieset.com, you agree to comply with and be bound by these Terms.

If you do not agree to these Terms, you must refrain from downloading or using any RAW photos from our platform.

1. License Grant

Upon your purchase or authorized access to the RAW Photos, you are granted a non-exclusive, non-transferable, and revocable license to use the Photos solely for the following purposes:

Personal Use: Editing, printing, and sharing with friends or family for non-commercial purposes.
Commercial Use: If explicitly stated in the purchase agreement, you may use the Photos for commercial purposes like advertisements, websites, or promotional materials. Commercial use may require additional licensing.

You are not granted ownership of the Photos, and all rights remain with Southend.media, the copyright holder.

2. Prohibited Uses

You may not:

Resell, redistribute, or sublicense the RAW Photos in any form.
Use the Photos in any manner that is defamatory, offensive, or unlawful.
Use the Photos in designs or products that are intended for resale (such as stock photography or templates) without proper licensing.
Alter the Photos in any way that infringes upon the integrity of the original content (for example, by claiming authorship or distributing altered versions as your own work).
Use the Photos for illegal, unethical, or immoral activities.

3. Intellectual Property

You acknowledge that the Photos are protected by copyright laws and that Southend.media retains full ownership of all intellectual property rights associated with the Photos. This includes, but is not limited to, the rights to the original files, editing rights, and any other derivative works that may be created.

4. Download Limitations

Download Access: After your purchase or authorized access, you will be provided with a download link for the RAW Photos. You are responsible for ensuring the download is completed within any specified time limit or access period.
File Integrity: Once downloaded, you assume all risk of damage, loss, or corruption of the RAW Photos. We are not responsible for any technical issues or file corruption that may occur after the Photos have been downloaded.

5. No Refund Policy

Due to the nature of digital content, all sales of RAW Photos are final. We do not offer refunds, exchanges, or returns once the Photos have been successfully downloaded, unless the content is proven to be defective or not as described.

6. Credits and Attribution

If required as part of the agreement or licensing terms, you agree to provide appropriate credit or attribution when using the Photos. The specific format of attribution will be provided at the time of download or purchase.

7. Privacy

Any personal information you provide to access or download the Photos will be handled in accordance with our [Privacy Policy]. By agreeing to these Terms, you consent to the collection and use of your personal data as outlined in our Privacy Policy.

8. Indemnification

You agree to indemnify, defend, and hold harmless Southend.media and its affiliates, agents, and employees from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the RAW Photos, including any unauthorized distribution or commercial exploitation of the Photos.

9. Limitation of Liability

In no event shall Southend.media be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the RAW Photos, even if advised of the possibility of such damages.

10. Termination

We reserve the right to terminate or suspend your access to the Photos if you violate these Terms or for any other reason, at our sole discretion. Upon termination, you must cease all use of the Photos and destroy any copies in your possession.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Kevin M. Any dispute arising from or in connection with these Terms shall be resolved in the competent courts of Kevin M.

12. Modifications

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and the updated version will become effective immediately upon publication. Please check this page regularly for updates.
